Terms of Service

These Terms of Service ("Terms") are an agreement between you and Jarzac Group Pty Ltd (ABN 58 606 370 012) ("Articulation Coach", "we", "us", "our"), which operates articulationcoach.com and the Articulation Coach service (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use the Service

You must be at least 18 years old to use Articulation Coach. By using it, you confirm that you meet this requirement.

2. What the Service does

Articulation Coach helps you rehearse high-stakes conversations. You are given a scenario, you answer it in your own words, by typing or speaking, and you receive a score and coached feedback on what you said. The Service is a practice and coaching tool.

3. Coaching is guidance, not professional advice

The scores, rewrites, and coaching provided by Articulation Coach are generated with the help of artificial intelligence and are intended as practice and guidance only. They are not professional, legal, financial, human resources, medical, or psychological advice. You are responsible for your own decisions and how you handle real conversations. Do not rely on the Service as a substitute for advice from a qualified professional.

4. Free and paid plans

Free. You can try the Service without signing up. The free plan gives you access to one programme of your choice and a limited number of scored rehearsals per day.

Pro. A paid subscription unlocks all programmes and scenarios, unlimited rehearsals, and additional features. The current prices are A$14.99 per month or A$99 per year. All prices are in Australian dollars. Prices may change, and we will give you notice of any change before it applies to you.

5. Accounts and sign-in

We sign you in using a one-tap link sent to your email. You are responsible for keeping access to your email secure, and for activity that happens under your account. Tell us promptly if you think someone else has accessed your account.

6. Subscriptions, billing, and cancellation

• Paid subscriptions are billed in advance through our payment provider, Stripe, on a recurring basis, monthly or annually, until cancelled.
• Your subscription renews automatically at the end of each billing period unless you cancel before it renews.
• You can cancel at any time from the "Manage billing" area of your account. When you cancel, you keep Pro access until the end of the period you have already paid for, and you are not charged again.
• Except where required by law, including under the Australian Consumer Law, payments are non-refundable. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded.

7. Your content

The answers you write or speak remain yours. By using the Service, you give us permission to store and process that content as needed to run the Service and give you feedback, including sending it to our AI provider for scoring, as described in our Privacy Policy. We do not claim ownership of your answers.

8. Our content

The scenarios, coaching, wording, design, logos, and all other material we provide are owned by us or our licensors and are protected by intellectual property laws. You may use them only as part of using the Service. You may not copy, resell, scrape, or redistribute our content, or use it to build or train a competing product, without our written permission.

9. Acceptable use

You agree not to:

• use the Service for any unlawful purpose;
• attempt to break, overload, or gain unauthorised access to the Service or its systems;
• resell or share paid access with others outside the terms of your plan; or
• misuse the Service in a way that harms us or other users.

We may suspend or end your access if you break these Terms.

10. Availability and changes

We work to keep the Service running well, but we do not guarantee it will always be available or error-free. We may change, add, or remove features over time. If we make a significant change to these Terms, we will update the date above and, where appropriate, let you know.

11. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, and other than guarantees that cannot be excluded under the Australian Consumer Law, we do not make promises about the accuracy of the coaching or that the Service will meet your particular needs.

12. Limitation of liability

To the extent permitted by law, our total liability to you for any claim connected with the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss. Nothing in these Terms limits liability that cannot be limited under Australian law, including under the Australian Consumer Law.

13. Ending your use

You can stop using the Service and close your account at any time. We may suspend or end your access if you break these Terms or if we need to for legal or security reasons.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of New South Wales.
